1. Agreement to Terms

By accessing or using CreaseyCo's website and services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.

These terms apply to all visitors, users, and clients of CreaseyCo services.

2. Services Provided

CreaseyCo provides the following services:

Web Design: Custom website design and development
Web Hosting: Website hosting services (where applicable)
Website Maintenance: Ongoing support and updates
Software Design: Custom software design and development

Specific services will be detailed in individual project agreements or quotations.

3. Project Process

3.1 Quotations and Proposals

All quotations are valid for 30 days unless otherwise stated
Prices are subject to change if project scope changes
Quotations are estimates and final costs may vary based on actual work required

3.2 Project Acceptance

Projects begin upon receipt of signed agreement and initial payment
Timeline estimates are provided in good faith but are not guaranteed
Delays caused by client (e.g., late content delivery) may extend timelines

3.3 Client Responsibilities

You agree to:

Provide accurate, timely information and content
Respond to requests for feedback within reasonable timeframes
Ensure you have rights to all materials provided (images, text, logos)
Review and approve work at designated project milestones

4. Payment Terms

4.1 Payment Information

Standard payment terms:

All packages: 100% upfront payment required before work commences
Custom quotes: Payment terms will be specified in your individual quote
Projects begin only after payment is confirmed and cleared

4.2 Payment Methods

We accept secure payments through the following methods:

Stripe Payment Portal: Secure payment links sent via email (credit/debit cards accepted)
Bank Transfer: Direct bank transfer to our account
Other Methods: Alternative payment arrangements (such as cryptocurrency) by prior agreement only

Payment Processing: All card payments are processed securely through Stripe, a PCI-DSS compliant payment provider. We do not store or have access to your full card details.

4.3 Payment Security

All payment links are unique, randomized, and expire after use
Payment links are sent only to the email address you provide
Card payments use 3D Secure authentication for additional security
Do NOT share your payment links with others
Report any suspicious looking payment requests immediately

4.4 Late Payments & Overdue Accounts

Payment is required before project commencement (100% upfront)
For custom payment plans: Invoices are due within 14 days unless otherwise agreed
Late payments may incur interest at 8% above Bank of England base rate
Work may be suspended for accounts more than 30 days overdue
We reserve the right to withhold delivery until payment is received in full

4.5 Refunds

No refunds: All payments are non-refundable once work commences
Before work starts: Full refund available if you cancel before we begin development
Partial completion: Refunds for incomplete work calculated based on work completed to date
After delivery: No refunds after final delivery and client approval
Disputes: Any payment disputes must be raised within 14 days of delivery

5. Intellectual Property

5.1 Ownership Transfer

You retain ownership of all content you provide
Upon final payment, you receive ownership of the final website design
We retain rights to reusable code components and frameworks
We reserve the right to showcase your project in our portfolio unless otherwise agreed

5.2 Third-Party Components

Websites may include third-party libraries, fonts, or plugins
These components remain subject to their original licenses
You are responsible for maintaining any required third-party licenses

6. Warranties and Disclaimers

6.1 Our Warranties

We warrant that:

Services will be performed with reasonable skill and care
Work will be substantially similar to approved designs
We have the right to provide the services offered

6.2 Disclaimers

We do NOT warrant:

Uninterrupted or error-free website operation
Specific search engine rankings or traffic levels
Compatibility with all future browser versions or devices
Security against all possible cyber threats

6.3 Limitation of Liability

Our liability is limited to the amount paid for services
We are not liable for indirect, consequential, or special damages
We are not liable for third-party actions, content, or services
We are not liable for losses due to factors outside our control

7. Hosting Services (Where Applicable)

7.1 Hosting Terms

Hosting is provided on a monthly or annual subscription basis
Free hosting periods are specified in package details
After free periods, standard hosting fees apply
Hosting includes reasonable bandwidth and storage

7.2 Uptime and Support

We aim for 99.9% uptime but cannot guarantee it
Planned maintenance will be announced in advance where possible
Emergency maintenance may occur without notice
Urgent support available 24/7 to all paying customers

7.3 Termination of Hosting

You may cancel hosting with 30 days notice of the renewal period
We will provide a backup of your website files
We may suspend or terminate hosting for non-payment or terms violations
Data is deleted 30 days after hosting termination

8. Revisions and Changes

8.1 Included Revisions

Each package includes customer revisions:

Revisions must be requested during designated review periods
Major scope changes are not considered revisions
Additional revisions may incur extra fees

8.2 Post-Launch Changes

Minor fixes within 30 days of launch are complimentary
Content updates and feature additions are billable
Ongoing maintenance packages are available

9. Cancellation and Termination

9.1 Client Cancellation

You may cancel at any time with written notice
You are liable for payment for all work completed to date
Payments for completed work are non-refundable
You receive all work completed up to cancellation point

9.2 Our Right to Terminate

We may terminate services if:

Payments are more than 30 days overdue
You breach these terms
You provide false or misleading information
The project becomes impractical or impossible to complete

10. Confidentiality

We will keep your business information confidential
Confidentiality survives project completion
We may disclose information if required by law
Public information is not considered confidential

11. Indemnification

You agree to indemnify CreaseyCo against claims arising from:

Content you provide infringing third-party rights
Your use of the website in violation of laws
Your breach of these terms

12. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including:

Natural disasters, pandemics, or extreme weather
War, terrorism, or civil unrest
Power outages or internet service disruptions
Government actions or changes in law
Third-party service failures

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may update these Terms & Conditions from time to time. Updated terms will be posted on this page with a new "Last updated" date. Continued use of our services constitutes acceptance of updated terms.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These terms, together with any project-specific agreements, constitute the entire agreement between you and CreaseyCo. They supersede all prior discussions, negotiations, or agreements.
